Distance Sales Agreement

Buyer: The consumer placing a reservation through the website.
2. Subject
The subject of this agreement is the sale and performance of the boat tour / Bosphorus tour / dining cruise service ordered by the Buyer through the lufertour.com website (“Site”), the characteristics and price of which are stated below, in accordance with Turkish Consumer Protection Law No. 6502 and the Distance Contracts Regulation.
3. Service and Price
The service is determined according to the tour, date, time, party size and options selected on the Site. Essential characteristics (departure pier, duration, inclusions/exclusions, child policy) are displayed on the relevant product page and order summary. The total price is VAT-inclusive and is shown clearly at checkout and in the confirmation e-mail.
4. Payment
Payments are processed via 3D Secure on the PCI-DSS certified payment institution Iyzico. Lufer Tour does not store card data on its servers. The order takes effect upon payment authorisation.
5. Time and Place of Performance
The service is performed on the date and time selected by the Buyer at the departure pier specified on the product page. The Seller reserves the right to change the pier and/or time, postpone or cancel the tour due to adverse weather, maritime safety or force majeure; in such cases the Buyer is offered an alternative date or full refund.
6. Right of Withdrawal (IMPORTANT)
The service is a leisure / entertainment service performed on a specific date and time. In accordance with Article 15/g of the Distance Contracts Regulation, the Buyer has no 14-day right of withdrawal. The Buyer expressly acknowledges this in the Pre-Information Form at checkout.
7. Cancellation and Refund Policy
- Cancellations made 24 hours or more before the tour: 100% refund of the amount paid is issued via Iyzico to the original payment method within 7-14 business days.
- Cancellations less than 24 hours before the tour, no-shows or late arrivals: no refund. The service is deemed performed.
- Seller-driven cancellations (weather, coast-guard order, force majeure): Buyer is offered an alternative date or 100% refund.
- Pier/time changes due to operational necessity: notified at least 6 hours in advance via e-mail/SMS; Buyer may join the revised programme or receive a 100% refund.
Refund requests are submitted via “My Bookings → Refund Request” on the Site or by e-mailing [email protected].
8. General Provisions
- The Buyer warrants that participants under 18 will be accompanied by a parent/guardian and that any health-related notice is given in advance.
- Passengers found to be under heavy influence of alcohol/drugs may be removed by the captain; no refund is issued in such cases.
- The e-mail address provided in the contact form is deemed a valid notification address.
- Disputes are subject to the jurisdiction of Istanbul (Anatolian Side) Consumer Arbitration Boards and Consumer Courts.
